1. Acceptance of Terms

By accessing or using the website operated by the Orange County Korean American Bar Association ("OCKABA," "we," "us," or "our") at ockaba.org (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. Please also review our Privacy Policy, which governs our collection and use of your personal information.

2. About OCKABA

OCKABA is a voluntary bar association serving Korean American attorneys and law students in Orange County, California. Membership is voluntary and open to eligible individuals as described on our membership page.

3. Account Registration

To access certain features of the Site, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as needed. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Membership

Membership in OCKABA is voluntary and subject to the following conditions:

• Membership tiers and fees are as described on the membership page and may be updated from time to time.
• Annual memberships require renewal each year. Lifetime memberships do not require renewal.
• OCKABA reserves the right to accept or decline membership applications at its discretion.
• Members must comply with these Terms and all applicable OCKABA policies.

5. Payments and Refunds

All payments for memberships, event registrations, and donations are processed through Stripe, a third-party payment processor. By making a payment, you agree to Stripe's terms of service.

All membership fees, event registration fees, and donations are non-refundable unless otherwise stated or required by law. This is consistent with standard practices among bar associations and professional organizations.

6. User-Generated Content

You may submit content to the Site, including profile information, photographs, and other materials ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant OCKABA a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content in connection with the operation of the Site and OCKABA's organizational activities.

You represent and warrant that you own or have the necessary rights to submit your User Content and that your User Content does not violate any third-party rights or applicable laws.

7. Member Directory

The member directory is available to OCKABA members. Participation in the directory is optional and can be controlled through your profile settings. Information displayed in the directory is intended for professional networking purposes only. You agree not to use directory information for unsolicited commercial communications, data mining, or any other purpose unrelated to OCKABA's mission.

8. Acceptable Use

You agree not to use the Site to:

• Violate any applicable federal, state, or local law or regulation
• Infringe upon the rights of others
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt the Site or its underlying infrastructure
• Attempt to gain unauthorized access to any portion of the Site or other users' accounts
• Use the Site for commercial solicitation without OCKABA's prior written consent
• Harvest or collect information about other users without their consent

9. Intellectual Property

The Site and its original content (excluding User Content), features, and functionality are owned by OCKABA and are protected by applicable copyright, trademark, and other intellectual property laws. The OCKABA name, logo, and related marks are trademarks of OCKABA and may not be used without prior written permission.

10. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by OCKABA. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You access third-party sites at your own risk.

11. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. OCKABA does not warrant that the Site will be uninterrupted, secure, or error-free. OCKABA does not provide legal advice through the Site and nothing on the Site constitutes an attorney-client relationship.

12. Limitation of Liability

To the fullest extent permitted by applicable law, OCKABA, its officers, directors, members, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Site. In no event shall OCKABA's total liability exceed the amount you paid to OCKABA in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless OCKABA, its officers, directors, members, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party rights.

14. Modifications to Terms

OCKABA reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Site after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Termination

OCKABA may terminate or suspend your account and access to the Site at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, OCKABA, or third parties. Upon termination, your right to use the Site will immediately cease.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
